These Terms of Service ("Terms") apply to physicians and physician assistants using the RxCe website, the RxCe mobile applications, and the continuing medical education activities provided by RxCe.com, LLC (the "Company," "RxCe," "we").

Pharmacists and pharmacy technicians are covered by separate Terms of Service, available at https://rxce.com/TermsOfService, which govern the paid continuing education we provide to those professions. If you are a pharmacist or pharmacy technician, those Terms apply to you rather than these.

By registering for an account or using our Services, you agree to these Terms, including the arbitration provision and class action waiver in Section 14.

We may make changes to these Terms from time to time. If we make changes, we will provide notice — by email, through the Services, or by updating the date above. Unless we say otherwise, amended Terms are effective immediately, and your continued use confirms your acceptance. If you do not agree, you must stop using our Services.

1. Everything Here Is Free

RxCe provides continuing medical education to physicians and physician assistants at no charge.

There are no fees, no subscriptions, no purchases, and no payment of any kind associated with your use of our Services. You will never be asked to pay for an activity, for credit, for a certificate, or for an account.

Our mobile applications contain no in-app purchases and no subscriptions. Nothing in them can be bought.

Some activities are separately accredited for pharmacists and pharmacy technicians, and are offered to those professions on a paid basis under separate Terms. That has no bearing on your access: the physician and physician assistant presentation of any activity is free to you, always.

2. Eligibility

You must be at least 18 years of age to register as a physician or physician assistant.

Our Services are intended for licensed physicians and physician assistants, and for students and residents in accredited medical or physician assistant programs.

If you use our Services on behalf of another person: all references to "you" include that person; you represent that you are authorized to accept these Terms on their behalf; and that person agrees to be responsible to us for any violation.

3. Accounts

Accounts are created on the RxCe website at rxce.com. Our mobile applications are sign-in only — you cannot create an account within the app.

You must provide accurate account information, including accurate professional credentials, and keep it current. Because we document and report the continuing education credit you earn, the accuracy of your name, license information, and professional identifiers is your responsibility.

Maintain the security of your account and notify us promptly if you suspect unauthorized access. We may reclaim accounts on behalf of individuals holding a legal claim to them, including trademark rights. Your account is not transferable, and we may terminate any rights to it in the event of your death, incapacity, or unavailability.

4. Deleting Your Account

You may delete your RxCe account at any time — on the website at Account → Manage → Delete Personal Data, or from within our mobile application, which opens the same page.

You will be asked to sign in, enter your password, acknowledge what is deleted and what is retained, and type DELETE to confirm. This is deliberate: an account cannot be deleted from a signed-in device alone.

Deletion is permanent and cannot be undone.

What we retain. Records of continuing education credit you have completed are retained in de-identified form, as our accreditors require and as described in our Privacy Policy.

What this means for you. Once your account is deleted, we cannot re-issue your certificates, verify your credit to a licensing or certifying board, or report any credit not yet transmitted. Download your credit transcript before deleting. You will receive a confirmation code by email — keep it, as it is the only reference we retain.

5. Continuing Education Credit and Certificates

We award continuing medical education credit and issue certificates to learners who satisfactorily complete an activity's requirements. Requirements vary by activity and may include a post-test, an evaluation, or both.

Reporting. Where reporting is required for the credit type, or where you request or authorize it, we transmit your completion to the applicable accreditation or licensing system as described in our Privacy Policy. It remains your responsibility to confirm that credit you have earned appears on your records with your licensing board, certifying board, or credentialing body, and to retain your certificates for as long as those bodies require.

In support of improving patient care, RxCe.com, LLC is jointly accredited by the Accreditation Council for Continuing Medical Education (ACCME), the Accreditation Council for Pharmacy Education (ACPE), and the American Nurses Credentialing Center (ANCC), to provide continuing education for the healthcare team.

Educational content only. Our Services provide professional education. They are not a substitute for clinical judgment, do not constitute medical advice, and are not intended for use in diagnosing or treating any individual patient. Do not submit patient information to us — see our Privacy Policy.

6. Honor Code

By enrolling in our activities, you agree that you will:

  • Complete all tests and assignments on your own
  • Maintain only one account, unless we have approved otherwise for an employer- or institution-sponsored program
  • Not let anyone else use your username or password
  • Not engage in any activity that would dishonestly improve your results or affect the results of others
  • Not post or distribute answers to problems used to assess learner performance
  • Accurately represent your professional credentials

Violations may result in a certificate being withheld or revoked, unenrollment, retraction of credit already reported to an accrediting or licensing body, or other action at our discretion.

7. Prohibited Conduct

You are solely responsible for your conduct while using our Services, and will not violate any applicable law, contract, intellectual property right, or other third-party right. You will not:

  • Impersonate any person or entity, or misrepresent your affiliation with one
  • Sell, resell, or commercially exploit our Services
  • Copy, reproduce, distribute, publicly perform, or publicly display any part of our Services except as we expressly permit
  • Modify our Services, remove proprietary notices, or create derivative works
  • Use our Services in any manner that could interfere with, disrupt, or impair them, or other users' enjoyment of them
  • Reverse engineer any aspect of our Services, or attempt to discover source code or circumvent access controls
  • Use data mining, robots, or similar extraction methods against our Services, including course materials, audio content, trademarks, or logos
  • Develop or use applications that interact with our Services without our written consent
  • Use our Services for any illegal or unauthorized purpose

Enforcement is at our discretion, and not enforcing in one instance does not waive our right to enforce in others. This Section creates no private right of action for any third party.

8. Ownership and Licence

The Services — including texts, exams, audio recordings, video, images, and other instructional materials — are owned by RxCe or our licensors and protected under United States law. All rights not expressly granted are reserved.

Subject to your compliance with these Terms, you are granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable licence to access and use our Services for your own personal, noncommercial use. Where you obtain our mobile application from an app store, this licence is further limited to devices you own or control, as permitted by that store's usage rules.

Any other use, without our prior written permission, is prohibited and terminates this licence.

9. Trademarks

RxCe, our logos, product and service names, slogans, and the look and feel of the Services are our trademarks and may not be copied, imitated, or used without our prior written permission.

Other trademarks are the property of their respective owners, including designations used by accrediting bodies such as AMA PRA Category 1 Credit™, which we use under the authority of our accreditation. Reference to any product, service, or organization does not imply endorsement.

10. Feedback

Any questions, comments, suggestions, ideas, or other materials you communicate to us ("Feedback") may be used by us for any purpose, commercial or otherwise, without acknowledgment or compensation, and may be treated as nonconfidential.

Course evaluations and commercial bias reports you submit are used as described in our Privacy Policy, including as accreditation evidence.

11. Third-Party Content

We may provide information about third-party products, services, or events, or allow third parties to make content available through the Services. Your dealings with third parties and your use of their content are solely between you and them. We do not control or endorse third-party content and make no representations or warranties about it. Your access to and use of it is at your own risk.

12. Disclaimers

Your use of our Services is at your sole risk. Our Services and their content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not represent or warrant that our Services are accurate, complete, reliable, current, or error-free, or that our servers are free of harmful components. You assume the entire risk as to the quality and performance of the Services.

13. Limitation of Liability

To the fullest extent permitted by law, RxCe will not be liable under any theory of liability — contract, tort, negligence, strict liability, warranty, or otherwise — for any indirect, consequential, exemplary, incidental, punitive, or special damages, or lost profits, even if advised of the possibility.

These limitations do not exclude liability for gross negligence, fraud, or intentional misconduct, or for any matter that cannot be limited under applicable law. Some jurisdictions do not allow certain exclusions, so they may not apply to you.

14. Dispute Resolution; Binding Arbitration

Please read this section carefully. It requires you to arbitrate certain disputes and limits how you can seek relief from us, unless you opt out below. No class or representative actions are permitted. Arbitration precludes suing in court or having a jury trial.

15. Governing Law and Venue

These Terms and your use of the Services are governed by the laws of Montana, except as preempted by U.S. federal law, without regard to conflict-of-law principles. Disputes not subject to arbitration and not heard in small claims court will be resolved in the state or federal courts sitting in Missoula County, Montana.

16. Modifying and Terminating Our Services

We may terminate, change, suspend, or discontinue any aspect of the Services at any time. We may restrict, suspend, or terminate your access if we believe you have violated these Terms or applicable law, or for any other reason, without notice or liability.

If we terminate your account, credit you have already earned is handled as described in Section 4 and in our Privacy Policy.

17. Mobile Applications Obtained Through an App Store

This Section applies where you obtain an RxCe mobile application through a third-party app store or distribution platform (an "App Provider"), including the Apple App Store and Google Play.

These Terms are between you and RxCe only, not with the App Provider. RxCe, not the App Provider, is solely responsible for the application and its content.

Support. The App Provider has no obligation to furnish maintenance or support for the application. Direct all support requests to help@rxce.com.

Warranty. In the event the application fails to conform to any applicable warranty, you may notify the App Provider, and where applicable it may refund the purchase price, if any. Our applications are provided free of charge, so no purchase price exists. To the maximum extent permitted by law, the App Provider has no other warranty obligation. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are RxCe's sole responsibility.

Product claims. RxCe, not the App Provider, is responsible for addressing any claims relating to the application or your possession or use of it, including product liability claims, claims that the application fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar legislation.

Third-party intellectual property claims. In the event of a third-party claim that the application or your use of it infringes intellectual property rights, RxCe, not the App Provider, is solely responsible for its investigation, defense, settlement, and discharge.

Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and are not on any U.S. Government list of prohibited or restricted parties.

Third-party beneficiary. The App Provider and its subsidiaries are third-party beneficiaries of these Terms as they relate to your licence of the application, and upon your acceptance will have the right to enforce these Terms against you as a third-party beneficiary.

Usage rules. Your licence is subject to the App Provider's applicable usage rules.

18. Severability

If any provision or part of a provision is unlawful, void, or unenforceable, it is severable from these Terms and does not affect the validity of the remainder.

19. Miscellaneous

Our failure to exercise or enforce any right or provision does not waive it. Section titles are for convenience only. Except as expressly provided in Section 17 with respect to App Providers, these Terms are intended solely for the benefit of the parties and confer no third-party beneficiary rights. You agree that communications and transactions between us may be conducted electronically.
